On August 27, 2026 (CEST), court documents submitted by UEFA's lawyers reveal that FIFA President Gianni Infantino's plan to sell a 20% stake in FIFA's tournaments for $4.2 billion is an "unreasonably low" valuation. UEFA is considering criminal action against Infantino.

According to U.S. court documents, UEFA is considering filing "criminal charges" against FIFA President Gianni Infantino over his plan to sell stakes in FIFA's tournaments.

Court documents submitted by UEFA's lawyers contend that the plan to sell a 20% stake in FIFA's tournaments for $4.2 billion (£3.1 million) is an "unreasonably low" figure that "was not the result of a competitive public auction process nor was it independently valued."

The 56-page document states: "UEFA and its advisors are considering filing criminal charges against Mr. Infantino and other FIFA officials under Article 158 of the Swiss Criminal Code for criminal mismanagement, and potentially other or alternative charges based on the factual record that has been developed."

"It is understood that Mr. Infantino's actions constitute criminal mismanagement. However, Swiss law does not require UEFA or its member associations to prove the likelihood of success before filing criminal charges."

They also state that if convicted, such criminal offenses could result in a maximum sentence of three years imprisonment.

Infantino had initially planned to allow private investors led by Joshua Kushner, brother-in-law of Donald Trump, to purchase stakes in a newly created company called FIFA Forward Enterprise (FFE). Infantino had previously defended the proposal, claiming it was designed to strengthen FIFA member associations, including those most in need of assistance. However, Infantino withdrew the plan three days after The Times revealed it. At that point, UEFA member nations had voted to boycott various FIFA competitions.

The legal documents also request that the court order Kushner's Thrive Capital fund to disclose all documents and electronic data related to FFE, and ask the court to issue subpoenas for Thrive and Kushner to provide evidence.

The court documents also reveal alleged financial incentives offered to FIFA's 211 member associations in exchange for their support of the plan—$40 million over four years, with a 75% reduction if the plan was rejected—and that they were required to decide within an extremely tight timeframe.

They state: "For many national football associations, such substantial payments would be extraordinary compared to their daily operational budgets.

"Moreover, these rewards would be paid from FIFA's future reserves and revenue, meaning member associations would receive a portion of FIFA's current funds in exchange for permanently ceding a portion of FIFA's future earnings.

"Mr. Infantino attempted to force members to consider this incentive within a strict timeframe. The response deadline set by Mr. Infantino and his associates was September 19, 2026—only approximately 53 days from July 28, 2026, when this major restructuring of FIFA's commercial assets, which had been secretly discussed for over a year, was announced."

Previously, UEFA's lawyers in New York sent a warning letter stating that all documents and information related to Infantino's plan must be preserved. This new action is taking place in that context.

In early August, UEFA's lawyers named 14 FIFA executives, including Infantino, requesting they "specifically preserve all documents related to the sale of FIFA tournaments that they own, manage, or control."

Meanwhile, at a meeting of the UEFA Executive Committee and its 55 member association presidents in Monaco, it was confirmed that the conditions for lifting the boycott of FIFA competitions have been met. The first condition was that FIFA withdraw the proposal to sell stakes in major tournaments, which was announced in late July; the second condition was to "ensure that such efforts to undermine football will never happen again."
